Ilya Kalchev, an analyst at Nexo Dispatch, interprets Bitcoin’s recovery post-Clarity vote, Fed rate hike, and liquidation event as a sign of consolidation rather than an impending breakout. “Bitcoin’s next move is now linked to a catalyst that it does not have yet,” Kalchev stated. “Having absorbed three separate shocks this month without a real repricing, the more likely near-term path is range-bound trading rather than a breakout.”

For traders, key levels to watch include $77,950, $79,300, and $80,000. A sustained move above $80,000 could pave the way for $81,400, signaling a potential upward breakout. Conversely, a drop below $75,000 would cast doubt on the current recovery trajectory, indicating a need for caution.

A New Era of Agency-Driven Regulation

While the Clarity Act’s failure leaves a void in statutory crypto regulation, the regulatory landscape is far from stagnant. Analysts now anticipate a definitive shift towards an agency-driven, rule-based approach, with the Securities and Exchange Commission (SEC) and the Commodity Futures Trading Commission (CFTC) taking the lead. Digital-assets executives expect these bodies to continue leveraging their existing authority to establish industry rules.

This shift is already evident. The SEC recently issued a temporary, conditional Innovation Exemption for eligible crypto platforms, facilitating the trading of tokenized U.S. stocks. Luke Davis, founder and chief market strategist, highlighted this as proof that regulatory progress can continue despite legislative setbacks. This proactive stance from regulatory bodies suggests a path forward for clarity and innovation, even without comprehensive new legislation.
