It claimed that two ex-staffers “stole its source code during their departure at a time when they were communicating with an OpenAI recruiter.” However, Judge Lin noted, “there is no allegation that the recruiter told them to do so.”
Further claims included two other former employees retaining work chats on their devices, one refusing to provide certifications about confidential information post-departure, and another attempting to access xAI data on hiring and datacenter optimization after joining OpenAI. Two additional employees were simply cited for leaving xAI for OpenAI. Judge Lin concluded that while these actions were attributed to individuals, “none of this… amounts to illegal behavior at OpenAI.” The judge emphasized, “Notably absent are allegations about the conduct of OpenAI itself.”
